Agreement to Terms

By accessing or using the Historical Adventures by Mail website and subscription service (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you ("Subscriber," "you," or "your") and Historical Adventures by Mail ("we," "us," or "our").

Eligibility

You must be at least 18 years of age to subscribe to our Service. By subscribing, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement.

Our Service is designed for children under 13, but all subscriptions must be purchased and managed by a parent or legal guardian.

Subscription Service

Service Description

Historical Adventures by Mail provides a monthly subscription service that delivers personalized historical letters to children. Each subscription includes:

  • One personalized letter per month from a historical character
  • Letters are tailored to the child's selected historical era and age level
  • Physical delivery via USPS to the mailing address provided

Subscription Plans

We offer the following subscription options:

  • Monthly Subscription: Billed monthly at the current rate, cancel anytime
  • Annual Subscription: Billed annually at a discounted rate, 12 letters delivered over 12 months

Pricing is subject to change with 30 days' notice to existing subscribers.

Billing and Payment

By subscribing, you authorize us to charge your payment method on a recurring basis according to your selected subscription plan. Payments are processed securely through Stripe.

  • Monthly Subscriptions: You will be charged on the same day each month until you cancel
  • Annual Subscriptions: You will be charged once per year on your subscription anniversary date

If your payment method fails, we will attempt to notify you and may suspend your subscription until payment is received.

Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription rate.

Cancellation

You may cancel your subscription at any time by:

  • Logging into your account and selecting "Cancel Subscription"
  • Contacting us at [email protected]

Cancellations take effect at the end of the current billing period. You will continue to receive letters through the end of your paid subscription period, but no further charges will be made.

No refunds will be issued for partial months or unused portions of annual subscriptions, except as outlined in our Refund Policy.

Delivery and Shipping

Letters are mailed via USPS to the address you provide during registration. Delivery typically takes 5-10 business days within the United States.

You are responsible for providing an accurate and complete mailing address. We are not responsible for letters that are undeliverable due to incorrect or incomplete address information.

If a letter is lost or damaged in transit, please contact us within 30 days of the expected delivery date, and we will send a replacement at no charge.

Intellectual Property

All content provided through our Service, including but not limited to letters, character descriptions, artwork, logos, and website design, is the intellectual property of Historical Adventures by Mail and is protected by copyright, trademark, and other intellectual property laws.

You may not:

  • Reproduce, distribute, or publicly display our content without written permission
  • Use our content for commercial purposes
  • Modify, reverse engineer, or create derivative works from our content

Letters are provided for personal, non-commercial use by the subscribing family only.

User Accounts

When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

Prohibited Uses

You agree not to use the Service for any unlawful or prohibited purpose, including but not limited to:

  • Violating any local, state, national, or international law
  • Infringing on the intellectual property rights of others
  • Transmitting viruses, malware, or other harmful code
  • Attempting to gain unauthorized access to our systems
  • Harassing, threatening, or impersonating others
  • Using automated systems (bots, scrapers) to access the Service

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • The content will be accurate, complete, or current
  • Defects will be corrected
  • The Service will meet your specific requirements

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HISTORICAL ADVENTURES BY MAIL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify, defend, and hold harmless Historical Adventures by Mail, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your violation of any applicable laws or regulations

Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on our website at least 30 days before the changes take effect.

Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must cancel your subscription.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of [Your State], without regard to its conflict of law principles.

Any disputes arising out of or related to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court to protect intellectual property rights.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Historical Adventures by Mail regarding the Service and supersede all prior agreements and understandings.
